Terms & Conditions

1. Definitions

1.1 “Company” refers to Steenkamp Bande, the provider of tyre sales and repair services.

1.2 “Customer” refers to any individual or entity purchasing products or services from the Company.

1.3 “Products” refers to tyres and related items sold by the Company.

1.4 “Services” refers to tyre fitting, repair, call-out repairs, and any other related services offered by the Company.

2. Application

2.1 These Terms and Conditions (“T&Cs”) govern all transactions between the Company and the Customer concerning the sale of Products and provision of Services.

2.2 By engaging the Company’s Services or purchasing its Products, the Customer agrees to be bound by these T&Cs.

3. Orders and Quotations

3.1 All quotations provided by the Company are valid for 14 days unless otherwise specified.

3.2 Orders are subject to acceptance by the Company and availability of Products.

4. Pricing

4.1 Prices are subject to change without prior notice but will not affect confirmed orders.

4.2 Prices include Value Added Tax (VAT) as per South African law.

5. Payment Terms

5.1 Payment is due upon completion of Services or delivery of Products unless credit terms have been agreed upon in writing.

5.2 Accepted payment methods include cash, electronic funds transfer (EFT), and major credit cards.

5.3 For credit accounts, payment terms are strictly 30 days from the date of invoice. Overdue accounts may incur interest at a rate of 2% per month.

6. Delivery and Call-Out Services

6.1 Delivery of Products or provision of call-out Services will be as agreed upon at the time of order.

6.2 The Company will make reasonable efforts to meet agreed-upon schedules but is not liable for delays beyond its control.

6.3 Risk in the Products passes to the Customer upon delivery or completion of Services.

7. Warranties and Liability

7.1 The Company warrants that Products and Services will be free from defects in material and workmanship at the time of delivery or completion.

7.2 Any defects must be reported within 7 days of discovery, and the Company reserves the right to inspect and remedy such defects.

7.3 The Company’s liability is limited to the replacement or repair of defective Products or Services or a refund of the purchase price, at its discretion.

7.4 The Company is not liable for any indirect, special, or consequential damages arising from the use of its Products or Services.

8. Ownership and Risk

8.1 Ownership of Products remains with the Company until full payment is received.

8.2 Risk in the Products passes to the Customer upon delivery or completion of Services.

9. Customer Responsibilities

9.1 The Customer must ensure that the vehicle is in a suitable condition for the provision of Services.

9.2 The Customer must provide accurate information regarding the required Services and any relevant vehicle details.

10. Indemnity

10.1 The Customer indemnifies the Company against any claims arising from misuse or improper handling of the Products or Services.

11. Intellectual Property

11.1 All intellectual property rights related to the Company’s branding, materials, and content remain the property of the Company.

11.2 The Customer shall not deface, brand, remould, retread, recap, or tamper in any way whatsoever with the Products without the Company’s prior written consent.

12. Governing Law and Jurisdiction

12.1 These T&Cs are governed by the laws of South Africa.

12.2 The Customer consents to the jurisdiction of the Magistrate’s Court, notwithstanding that the amount in dispute may exceed the jurisdiction of the Magistrate’s Court.

13. Amendments

13.1 The Company reserves the right to amend these T&Cs at any time. Updated versions will be made available on the Company’s website.

14. Severability

14.1 If any provision of these T&Cs is found to be invalid or unenforceable, the remaining provisions shall continue to be binding and in full force.

15. Entire Agreement

15.1 These T&Cs constitute the entire agreement between the Company and the Customer and supersede all prior agreements or understandings, whether written or oral.
